Welcome to K1 Trucking & Hauling Xpress L.L.C. These Terms of Service ("Terms") apply to your access and use of our website and services. By engaging with our platform or contracting our logistics solutions, you agree to be bound by these professional standards and legal requirements.
1. Service Agreements & Quotes
At K1 Trucking & Hauling Xpress, we provide logistical precision. All quotes provided via our digital platform or representative communication are initial estimates. These figures are subject to adjustment based on final shipment weight, dimensions, fuel surcharges, and specific handling requirements at the time of transit.
A binding hauling agreement is formed only upon the client's formal acceptance of a final quote and K1’s written confirmation of equipment and driver capacity. The client maintains absolute responsibility for providing accurate shipment descriptions; discrepancies may result in rate adjustments or service delays.
2. Payment Terms
K1 Trucking & Hauling Xpress operates on a standard Net 30 days billing cycle for established accounts from the date of invoice. For new clients or one-time hauling agreements, payment may be required at the point of delivery or according to the specific freight terms agreed upon during booking.
Accepted payment methods include bank wire transfers, ACH, and corporate credit cards. Late payments are subject to a 1.5% monthly financing fee. Failure to settle outstanding balances may result in a temporary suspension of logistics services and reporting to freight credit agencies.
3. Liability and Cargo Claims
Our commitment to operational excellence includes a transparent approach to trucking liability. K1 Trucking & Hauling Xpress maintains liability limits governed by the Carmack Amendment and specific carrier contracts. Standard liability for loss or damage is limited to $0.50 per pound unless a higher value is declared in writing and additional valuation fees are paid prior to transport.
Notice of intent to file a freight claim must be submitted within 9 months of delivery, or in the case of non-delivery, within 9 months after a reasonable time for delivery has elapsed. K1 shall not be liable for damages caused by acts of God, public enemy, authority of law, shipper negligence, or the inherent nature of the cargo.
4. Governing Law
These terms and all logistics contracts entered into with K1 Trucking & Hauling Xpress L.L.C. are governed by the laws of the State of Missouri.
Any legal action or proceeding related to our services or these Terms shall be instituted exclusively in the federal or state courts located in Cape Girardeau County, Missouri. Users and clients hereby consent to the personal jurisdiction of such courts for the purpose of resolving any disputes.
